Terms and conditions

These terms apply to buying CDs and other goods from Harafica through this website. The seller is Harafica z.s., a registered association, company number 27055701, with its registered office at Vřesová 13, Sady, 686 01 Uherské Hradiště, Czech Republic, entered in the register of associations kept by the Regional Court in Brno under file no. L 12228, e-mail cm@harafica.eu.

The Czech version of these terms is the binding one; this is a translation for convenience.

The order and the contract

You choose the goods in the basket and complete the order in the form. Before you send it you can see what you are ordering, for how much and where it is to go, and you can correct the details; until you send it you can go back at any point. Sending the order obliges you to pay. The contract is concluded when we confirm the order by e-mail, and it is concluded in Czech. We keep the order in electronic form and will send it to you on request.

Prices

Prices are shown with each item and are final. Delivery is charged on top and differs according to whether the goods go to an address or to a pickup point. You see it in the order, together with the total, before you send it.

Payment

Payment is by bank transfer in advance. We send you the payment details by e-mail once the order reaches us, and we dispatch once the money arrives. If it does not arrive within fourteen days, we cancel the order and let you know.

Delivery

We ship with Zásilkovna within five working days of the payment reaching our account. Zásilkovna lets you know as soon as the parcel is ready.

Withdrawal from the contract

As a consumer you may withdraw from the contract within fourteen days of the day you or a person you name takes delivery. It is enough to send notice of withdrawal to cm@harafica.eu within that period; you may use the model form below.

Send the goods back to us no later than fourteen days after withdrawing, to the registered address given above. You bear the cost of returning them. We will refund the price of the goods and of delivery within fourteen days of the withdrawal, by the same means you paid, once we have the goods back or you show that you have sent them. We refund delivery at the cheapest rate we offer.

You are liable to us for any reduction in the value of the goods caused by handling them other than as needed to become acquainted with their nature and properties.

There is no right of withdrawal for an audio recording supplied in a sealed package once you have broken the seal. For CDs that means we cannot take an unwrapped one back.

Rights from defective performance

Rights from defective performance follow the Czech Civil Code. If the goods are defective, you can claim with us within two years of taking delivery and ask for repair or replacement; where that is impossible or would take unreasonably long, you can ask for a discount or withdraw from the contract. A defect that appears within one year of delivery is presumed to have been there at delivery.

Make the claim by e-mail to cm@harafica.eu or by letter to the registered address given above. We will confirm when you made the claim, what it concerns and how you want it settled. We will settle it within thirty days and let you know the outcome.

Out-of-court settlement of disputes

If we cannot agree, you can turn to the Czech Trade Inspection Authority, Štěpánská 796/44, 110 00 Prague 1, coi.gov.cz, which handles out-of-court consumer disputes. The European online dispute resolution platform at ec.europa.eu/consumers/odr is also available.
